In this agreement the following expressions shall have the following meanings:
Agreed contract price: The total price inclusive of value added tax payable to the works
shown in the quotation.
The Agreement: Theese conditions of contract and the quotation.
The Agreement Date: The date shown in the quotation.
The Customer: The person, firm or company whose is entered in the box headed
customers Name and addresses`
in the quotation.
The Goods: The windows / Doors and such ancillary items as deemed necessary to be
provided in accordance with the quotation.
The Premises: The installation address shown in the quotation.
The Quotation: The enquiry form shown overleaf.
The Works: The works to be carried out in installing the goods specified in the quotation.
On completion of the works and payment in full of the agreed contract price, GR Windows shall
guarantee the works and goods against faulty design, materials and workmanshipfor the following
periods
from the date of completion of the works-:
Sealed Glazing units 10 years
White UPVC Windows & Doors 10 years
Brown woodgrain finish UPVC Windows & Doors 10 years
This guarantee will cover both the labour and the material costs incurred for any remedial
covered by this
guarantee. This guarantee shall not apply if damage is caused by misuse, abuse or lack of
maintenance of the installation.
In the event of the sale of the premises, the purchaser will be entitled to the benefits of this
guarantee
at a cost of £100 payable to GR Windows.
Where the customer deals a sa consumer, the remedies in this clause are without prejudice to
and in addition to any warranties, indemnities, remedies or other rights provided by the lawfor
the benefit of the customer.
Whilst every care is taken to avoid unnecessary damage the customer accepts and acknowledges
the normal problems which can occur when building works are affected to a property which is
already occupied. The cost to be charged for the works includes making good the plastering,
flooring, brickwork and exterior rendering immediately surrounding the installation.
GR Windows will endeavour to ensure that the work matches existing finishes but will not
guarantee the matching of external specialist finishes such as
pebble dashing, tryolean or similar materials.
The quotation does not include redecoratingany portion of the premises disturbed during
the execution of works.
Title in the goods or any part thereof shall pass to the customer when payment of the agreed
contract price has been made.
GR Windows shall not be liable to the customer for any indirect or consequential loss
arising out of or in connection with the carrying out of the works.
The total liability of GR Windows for any other loss of the customer arising under the terms
of the agreement shall not exceed the agreed contract price .
The balance of the agreed contract price is due and payable at the time of completion of the works.
You shall hand to GR Windows approved installers or authorised representative on site the balance
due in full, unless otherwise agreed in writing by GR windows.
If the payment is not made in full on completion, then interest shall be payable at the rate
of 4% per annum above the base rate of HSBC from time to time all amounts outstanding until
payment thereof, such interest to run from day to day and to accrue after as well as before
any judgement.
On completion of the works to the satisfaction of the customer, the customer shall sign a
completion certificate provided by a GR Windows authorised representative.
In the event of the balance of the agreed contract price being payable by virtue of credit
arrangements entered into with GR Windows or any other organisation arranged via GR Windows
or its agents, on the
completion of the works the customer shall hand to GR Windows or authorised representative
any certificate of satisfaction as may be required by the terms of the credit agreements
and shall show to such representative the customers copy of the credit agreement.
This contract is not subject to cancellation by the customer except as provided for under
the cancellation provisions in part V of the customer credit act 1974 and further except
that the purchaser has the right to cancel this agreement by written notice within the period
of 7 days from the date shown on the order form.
Written notice of cancellation must be given by detaching the cancellation form and sending
by recorded delivery to the company secretary GR Windows, address provided.
With out prejudice to clause above in the event of consumer requesting the company to
cancel the contract prior to the commencement of manufacture the company may in its absolute
discretion agree to such cancellation provided the company is reimbursed by the customer for
any costs and expenses incurred and for anticipated gross profit which would have been yielded
by the contract.
The company reserves the right to cancel the contract if: in the opinion of the company the
installation cannot be satisfactorily carried out.
Time for delivery is not the essence of the contract. The anticipated delivery period quoted
is that anticipated at the time of the order and whilst GR Windows undertake to make every effort
to maintain or improve upon it no guarantee is given that the delivery period will be maintained.
Double glazing sealed units are designed primarily to reduce the heat loss which occurs through
singlem glazing. The presence of condensation is dependent upon the environment witin the dwelling.
The guarantee covers only the non penetraion of moisture within the sealed unit.
Gr Windows gives no warranty concerning the incidence, prevention or elimination of condensation
following the installation of its products, neither do its personnel have such authority to give such warranty.
GR Windows shall not be liable for failure to perform any of its obligations under this agreement
if such failure is due to any cause whatsoever beyond its reasonable control or that of its
sub-contractors or agents.
Representative and showroom samples are used to demonstrate typical products,
their composition and general appearance.
The windows and/or door(S) schedual will be measured manufactured and installed
in the way the company considers most suitable. Under the company`s policy of continuous
improvement it reserves the right to make any necessary modifications without notice.
These conditions, together with a signed order, consitute a complete record of the terms for
the supply and/or the installtion of the company`s products.
Subject to customer`s statutory rights under part v of the consumer credit act 1974,
no variations of these terms shall be considered.
By entering into this contract the customer confirms that the customer has read and understood
all of these terms and conditions.
